Health and Safety Regulations in Hotels As the facilities Manager of our hotel that I am very concerned about the lack of awareness of safe working practices amongst our employees. Therefore, this presentation will help them to understand and practice health and safety regulations at workplace. This presentation helps to ensure that our hotel operation run well and meet our customers expectations as well. But I should keep our hotel functioning at its best and want to assure that you work safe and healthy at the hotel. It can be seen that all legislation regarding to health and safety regulations have been developed since 1970s to ensure that management responsible for providing and maintenance of adequate policies and standards. Under the common law assure that employers have a duty of care about their employees who work at workplace. It is very important of having health and safety regulations at workplace. Because, employer fails to take care of an employee means that employee may have a number of claims. It would include the ability to resign and claim constructive unfair dismissal and claiming personal injury as well. The necessity of Health and Safety regulations This chapter draws the attention of the necessity of health and safety regulations. Health and Safety regulation may help various ways to business. It can be highlighted that the one of the main reasons of the necessity of health and safety regulations is to ensure that the work premises is running safely thus reducing accidents at workplace. One of the biggest risks for hotel workers is ergonomic injury from strains, sprains, and repetitive work. It helps to protect workers back and limbs by practicing safety regulations when performing your job functions. On the other hand every persons objective should be to maintain the maximum level of health and safety in the hotel. There are regulations and rules that manage this issue. Each employee of the hotel should be made aware of these rules and regulations. It is to say that once the hotel workers read through the health and safety regulations they realize that most of those are common sense. The knowledge about these regulations would help them to know how to react if there is a crisis. As the hotel management, that would not enough to give our employees to read down the health and safety regulations. We should encourage them to practice it. The best way is to practice this by example. If this practice starts right from the top level of the hotel it spreads down to the entire employee. It should be mentioned that this is vital for the well being of the hotel workers. Once hotel employees make understand that these health and safety regulations are for their wellbeing and benefit them will be more willing to act in accordance with hotel management. All these health and safety regulations are a must in the workplace which is required by law. Importance of health and safety within the hotel environment It should be mentioned that health and safety is one of the most important part within the hotel premises. Keeping poor level of health and safety leads to accidents and illness and significant costs for our hotel. Successful health and safety regulations practice means that improve our hotel reputation with hotel customers, regulators and our own hotel staff. We have both legal and moral obligation to ensure that our employees work in healthy and safely at the hotel. Hotel management cannot force workers to work in an environment where their wellbeing is risk. On the other hand those hotel workers are both healthy and safe during their working hours. Injured or sick hotel workers lead to drop in service and a subsequent loss of profits. Good health and safety practices successfully pay for themselves as service keep remain from minimising insurance costs, disruption, the hotel workforce remains contended and customers also are happy with hotel service. The hotel workers need training in specific areas. For example, workers may need to learn how to handle and dispose of cleaning liquids. On the other hand all supervisors also may need to deliver health and safety policies towards our hotel employees. Key health and safety issues in the hotel Safety Audit Safety audit is able to identify the possible problems before they have an impact on hotel safety. Its object is to reveal the strengths and weakness, to determine areas of non tolerable risk and devise rectification measures. Safety audit is able to ensure compliance with all current regulations related to safety and health at workplace. The main object of safety audit is to collect information, using a predetermined protocol or a checklist, whether how workplace safety services are currently going on. The safety audit can cover the particular aspects or whole system. It is important to hold this safety audits that helps to highlight all positive and negative aspects of safety in the workplace. Safety audit may include the current system in workplace to control hazards, the record of incidents at the workplace and a physical inspection of the premises. Finally, that would help to report findings, as well as suggestions to improve the current safety policy and system. Benefits of safety audit at the Hotel Safety audit mainly evaluate hotels safety services. On the other hand it can cause to great cost savings by injuries at work. Main object of the act can be outlined as health, safety and welfare of persons at work.It is clear that this act mainly focuses on employees at workplace. Not only workers, it protects persons other that persons at work, against risks to health or safety arising out of or in connection with the activities of persons at work. The act refers to control the keeping and using of explosive or highly flammable or otherwise dangerous substances, and generally preventing the unlawful acquisition, possession and use of such substances. On the other hand HASAWA control the emission into the atmosphere of noxious or offensive substances. I would disclose the duties of employers at workplace. The act provides that employer has duty of care about their employees. It can be clearly understood according to the chart below. Duties of Employer On the other hand it should be cited that employees also have to follow the duties and responsibilities which is under Health and Safety at Work Act. It is clearly cited below table. Responsibility of employee Hazard Spotting Hazard spotting is one of the most important things in the hotel. It will be of benefit to our hotel, staff and our guests as well. Therefore, I would like present and suggest action to be taken to resolve hazard spotting in our workplace. This would cover as many hazards as possible. To get reduce hazards in our hotel you will need to walk through our hotel, speak to employees. It is important that paperwork alone will not prevent injuries. It is very important to take action once a hazard has been identified. Therefore, I suggest taking action to prevent any hazards in many areas in the hotel premises. It is easily identify hazards that you may have not been previously identified once you work through the hotel. Hazard spotting involves looking for possible issues such as changes in working processes, temporary trip hazards, make sure only approved chemicals are used, etc. Any new hazards that you are found can then be dealt with either immediately or, if this is not possible, brought to the attention of the hotel administration. It is to be mentioned that there should be specify Hazard spotting exercises to conduct throughout the hotel regularly. Therefore, Nominate few persons who should be responsible for conducting the Hazard Spotting exercise Each one should be familiar with the area which the carry out the Hazard Spotting exercises Each Hazard Spotting need to be noted down with any new hazards as well Keeping a hazard spotting records which can be accessed by online. Use a checklist and make hazards list that you can see Accident reporting It is legal requirement that keeps a record of injuries in the hotel using an accident book. Employer must report certain serious workplace incidents to the hotel authorities. Accident reporting records must keep for at three years. As we employer that we have to provide an accident book for our staff and that should easily be understood. As you are the employer of work premises you are required to report some types of work-related diseases, accidents, and dangerous occurrences. Reporting ill health and accidents at workplace is a legal requirement under the Reporting of Injuries, Diseases and Dangerous Occurrences. Gathering information helps to Health and Executive and the Local Authority to recognize how and where risks arise and to prevent reoccurrence and prevent further suffering and pain to employees. Legal requirements ask to report a death, a major injury, an over three day injury, a work related disease, a dangerous occurrence and where a member of the public is taken directly to the hospital. Reporting accidents are required in time limit and it is vary depending on the severity. A major injury or where the accident has resulted in someones death need to be reported immediately. Over three day injuries need to be informed within ten days. It is noted that a work related diseases must report after the doctor diagnosis it. It is to mention that we must have a written policy of safety. We are a hotel who has employees more than four. It is to say that health and safety policy should be available for our staff. On the other hand safety policy must be reviewed regularly. (eg: annually) meaning of policy in place in order to establish who is responsible for what aspects of safety in our hotel. It is an important duty of this hotel to ensure that our employees work under a safe and healthy environment. An effective health and safety policy requires the full co-operation and collaboration of all employees. Responsibilities of the hotel employees; to take all reasonable care for the health and safety of him/herself and of fellow employees and to report any hazard which cannot be controlled personally to co-operate with the organisation by observing safety rules and complying with any measures designed to ensure a safe and healthy working environment. The role of safety co-ordinator is of vital importance for maintaining a continuous and critical scrutiny of working conditions throughout the workplace, reviewing safety performance and promoting safer working. The managing director accepts ultimate responsibility for health and safety within the organisation as a whole. All managers and employees generally are expected to support and implement this policy wholeheartedly. HACCP HACCP refers to prevent any kind of hazards that would be caused for food-borne illness by applying science based controls. It enables you to show your commitment to food and customer satisfaction. HACCP is an international principle defining the requirements for effective control of food safety. HACCP is built on seven key principles: hazard analysis, critical control points identification, establishing critical limits, monitoring procedures, corrective actions, verification procedures and record-keeping and documentation. Hazard analysis analysis of chemical, physical and biological food hazards Critical control points identify the critical points at the raw materials, processing, storage, distribution and consumption steps Establishing critical limits establishment of critical preventive measures and control limits, eg: minimum cooking time and temperature Monitoring procedures observing of these control points Corrective actions establishment of corrective actions Verification procedures Record keeping record; and Record-keeping and documentation Systematic and regular auditing of the systems in place by independent third party certification bodies. All those measurement can be maintain HACCP in workplace easily. Summary It can be seen that health and safety is good for hotel employees and the hotel as well. If employees are getting sick or injured that could result in time and money being wasted. We have planned to place the health and safety regulations in a variety of areas where the hotel employees can read them easily. Once you realize that these regulations are for your well being and benefit you will be more willing to comply with the hotel. It means we have been successful in cultivating a culture of health and safety at the hotel. It is to be advised to practice safe ergonomic principles when performing your job functions. Furthermore, keep your body and back straight and neutral while you work. Read the safety data sheets and labels to know the hazards and safe work practices for the chemicals products you use. It is important that you get training and inspect your cleaning and maintenance tools before use. The above recommendation and evaluations are general guidance only and should not be relied upon for legal compliance purposes. The Uniform Commercial Code By Wesley Shropshire Abstract The Uniform Commercial Code has many requirements and laws that govern it not only in trading within our country but also in trading internationally. It has been brought into question if we as a nation need to make some serious changes or update some of the laws when it comes to trading internationally. If we leave it like it is then many problems can arise and make most big business discouraged or even stop trading internationally altogether. With this being the case it makes it very hard when deciding what the effect the U. C. C. as on international commerce and there will be many factors brought up on to which side it leans toward. The Uniform Commercial Code The Uniform Commercial Code (UCC), a comprehensive code addressing most aspects of commercial law, is generally viewed as one of the most important developments in American law. The UCC text and draft revisions are written by experts in commercial law and submitted as drafts for approval to the National Conference of Commissioners on Uniform State Laws (now referred to as the Uniform Law Commissioners), in collaboration with the American Law Institute. (Uniform Commercial Code, (n. . ). Attorneys, which are the Commissioners include federal and state judges also including law professors and legislators, are able to practice law throughout the U. S. These organizations decide and meet on whether to send drafts back for revision or if they should endorse them. Most of the time it does not involve only one revision but after deciding to endorse them the states are forced to adopt these rules by the Uniform Law Commissioners. Since the Uniform Commercial Code, which is a model code, does not always have jurisdiction in a legal effect unless the legislatures as statutes enact them. Domestic transaction†means a transaction other than an international transaction. â€Å"International transaction†means a transaction that bears a reasonable relation to a country other than the United States. Computers and technology has grown rapidly over the past fifteen years, and this has enhanced the growth of financial markets globally which has led to around the clock trading in foreign exchange, financial instruments, and securities. Services and goods in international trade have also grown in speed and volume.Since the growth and change in technology settlements of payments in these transactions has sped up how fast they can receive these payments. Because of this money is being moved around the world faster than ever before. The economic significance of national boundaries to large corporations and financial institutions is being reduced. These trends in transactions, payments, and transnational operation of corporations have led to commercial pressure for greater certainty and uniformity in the law governing international transactions. Rules of private international laws will be the deciding factor into which jurisdiction laws that will be enforced. When it comes to commercial interests many are against this grey area of unknown and look for certainty in which legal rules in these international transactions to reduce and correctly measure the legal risks they may be taking. They also are pushing for the unvarying of these rules throughout jurisdictions in order to lower compliance costs.Because of the pressure for more uniformity and certainty in international transactions and the legal rules they are governed by, the private international law rules are being added to too bring together the legal rules at hand in international conventions to be foreseen across the nations. There has been little to no attention paid to what these international laws represent and I think and the United States should make it a part of their laws . With this being said pressure is rising on responsibilities of state and federal governments to fit these international developments and should deserve more attention than what they are receiving.The Uniform Commercial Code will reach a point where the process will need to be revised and when it takes place it will put these processes to the test. Because of failure in the enactment process there has been a lot of doubt on the uniform law process and its vitality, and this has caused even more doubt that changes can be made on an international level. Donne’s Poetry Essay
This essay will look at the form, structure and content of â€Å"The Relic†in an attempt to offer an explanation as to what the poem is about. It will examine the metaphysical poets, and discuss the techniques employed by them to express their views. â€Å"The Relic†consists of three 11-line stanzas which incorporate tetrameter (four metrical feet), pentameter (five metrical feet) and two tri-meter (three metrical feet) lines per stanza. It is written mainly in iambic pentameter and has a rhyming pattern of aabbcddceee. This gives the poem a songlike quality which is associated with this type of lyric poetry. Each stanza is made up of a single sentence which, with the help of the meter, forces the first four lines of each verse to be read rapidly. The caesura then slows down the reading, causing the reader to reflect more deeply on what has been said. In the first line of â€Å"The Relic†, Donne uses images allied with death. This makes it easy for the reader to mistake the theme of the poem as being about dying. By using the personal pronoun ‘my’ (l. 1) placed alongside the noun ‘grave’ (l. 1) it is suggested that it is Donne’s own grave which is being made reference to, thus reinforcing the impression of a mournful poem. However, when Donne goes on to describe the exhumation of his and his lover’s corpses, after they have rotted away, the poem changes from embodying death to celebrating love. The reader becomes aware that although he is dead, death is not the true significance here. The move from death to love is introduced with: ‘A bracelet of bright hair about the bone,’ (l. 6). This line could be interpreted as a wedding ring joining the couple together; adding to the intensity of their love. However, this is explained in ‘The Funeral’ (p 309) as ‘a lock of hair tied about his arm’ (p 309). This explanation could detract from the power of the line. The line seems to have more potency without this knowledge, adding an extra dimension to the poem, so allowing the reader to draw their own conclusions about the relationship between the couple. The juxtaposition of a grave with a pair of lovers is a powerful, paradoxical metaphor that is shocking to the reader. This pairing would not automatically be seen as romantic but Donne succeeds in conveying this impression. By indicating that the gravedigger would ‘think that there a loving couple lies,’ (l. 8) after noticing the ‘bracelet of bright hair about the bone,’ (l.6), Donne successfully communicates that ‘The Relic’ is a poem about eternal love; love has survived beyond death. This collocation of opposing elements is a technique often employed by the metaphysical poets to express their thoughts and feelings. The metaphysical poets were influenced by Neo-Platonism ; a system of philosophical and theological doctrines . However, this highly abstract and over theoretical approach to poetry can make it less accessible; alienating a vast selection of readers. Poetry should not only be about intellectual superiority which, it could be argued, is often associated with the metaphysical poets. This appeared to be the view of Samuel Johnson, who was the first to label this generation of authors ‘The Metaphysical Poets’: The most heterogeneous ideas are yoked by violence together: nature and art are ransacked for illustrations, comparisons, and allusions; their learning instructs, and their subtilty surprises; but the reader commonly thinks his improvement dearly bought, and, though he sometimes admires, is seldom pleased. T. S. Eliot, whilst admitting the difficulty in defining metaphysical poetry, opposed Johnson’s view. When considering ‘Donne’s most successful and characteristic effects †¦ ’ he used sections of the line ‘A bracelet of bright hair about the bone,’ (l. 6) to illustrate his approval of their methods: †¦ the most powerful effect is produced by the sudden contrast of associations of ‘bright hair’ and ‘bone’. This telescoping of images and multiplied associations [†¦ ] is one of the sources of the vitality of their language. (p 1099) If we look again at line 8 of â€Å"The Relic†, it is noticeable that the gravedigger would only ‘think that there a loving couple lies,’ (l. 8). It would be logical to assume that a husband would be buried with his wife, so the use of ‘think’ (l. 8) is puzzling. By following this with the apparently polysemous ‘lies,’ (l. 8) the poem could be read differently, altering the entire meaning to suggest that their love was only a fantasy. Another characteristic of metaphysical poetry is its tendency to use religious imagery to express its views. Towards the end of the first stanza, â€Å"The Relic†introduces the concept of ‘their souls, at the last busy day,’ (l. 10). This has been interpreted as a veiled reference to judgement day and leads the reader smoothly into the second stanza where the images of death are replaced with a high lexical density of religious vocabulary. Donne uses lexis such as ‘mis-devotion’ and ‘doth command’ (l. 13); ‘Bishop’ (l. 15); ‘relics’ (l. 16); ‘Mary Magdalen’ (l. 17); and ‘miracles’ (ll. 20-22) in order to extend the religious metaphor, introduced at the end of the first stanza, to evoke powerful images in the mind of the reader. Donne raises the question, in line 17, of who the ‘I’ really is here? It has been suggested, all through time, that Mary Magdalene was the wife of Jesus and perhaps even bore him a child. This idea of Mary Magdalene’s companion perhaps being Christ seems to be a concept that the metaphysical poets would enjoy debating; so adding a cerebral quality to their work. The line ‘All women shall adore us, and some men;’ (l. 19) juxtaposed with the repetition of ‘miracles’ (ll. 20-22) adds credence to the idea that Christ is lying beside Mary Magdalene, especially when the reader takes into account the reference to ‘harmless lovers’ (l. 22). The fact, that this couple ‘wrought’ (l. 22); which means moulded or formed; ‘miracles’ (l. 22) suggests that the ‘I’ (l.17) could be a reference to Jesus. The suggestion that when the couple are finally dug up they will be presented to ‘the Bishop and the King,’ (l. 15) further strengthens this connection with Christ. A Bishop (who is a senior member of Christian clergy) is thought to be a successor of the twelve Apostles of Christ by some churches, and a King is the ruler of a kingdom. Only the most important of people would be afforded the privilege of an audience before either of these men. In the first stanza it is automatically assumed that Donne is the man lying in his grave. This is simply because he is the author of the poem and he uses the possessive pronoun ‘my’ (l. 1) in the first line. This poses the question, if he was referring to Jesus, was Donne likening himself to Christ? The reader is left to wonder. There is a shift in focus from the overtly religious second stanza to a more reflective account of the couples love in the final stanza. It is implied, in the first line, that the relationship was not as perfect as previously indicated. The use of the adverb ‘First,’ (l. 23) placed before ‘we loved well and faithfully,’ (l. 23) could indicate that at a later date the couple did not love each other quite as honestly as they had once done. This is followed with what could be considered as a lament from someone who has lost their lover. The use of the past tense, with the verb ‘knew’ (l. 25) rather than ‘know’ seems to signify an ending to the relationship which has occurred whilst the couple were still alive. This is reinforced with the line: ‘nature, injured by late law, sets free: / These miracles we did;’ (ll. 30-31). Therefore the injuries caused by human law are more important than the ‘miracles’ (l. 31) of their love, which are insignificant as they are set ‘free’ (l. 31) or cast aside. This indicates their love was not strong enough to conquer the laws of their time. This could also be a further reference to Christ and Mary Magdalene as, had they had a relationship, they could both have been forced to forego their love for Christianity; an idea that Donne would perhaps want to offer up for consideration. In the final lines, if we take ‘measure’ (l. 32) to mean prosody (the study of poetic meter) and language to mean the lexis being used, the vocabulary seems to be reflective of the poem itself. These lines appear to say he feels he should communicate the information to others but is unsure whether he should tell others of the ‘miracle’ (l. 33) he feels the woman besides him was. As the poem is already doing this, it is playing a game with the reader. In conclusion, Donne uses specific poetic techniques in an effective and striking way. However, the reader often gets lost in trying to define exactly what he is trying to say. It could be argued that the power of poetry should lie in its subjectivity; each reader being able to take away what they want from the reading. After all, in the words of Cleanth Brooks : There is no ideal reader, of course, and I suppose that the practising critic can never be too often reminded of the gap between his reading and the â€Å"true†reading of the poem. Friedrich Von Steuben Friedrich Wilhelm August Heinrich Ferdinand Steuben, also known as Friedrich Von Steuben or Baron Von Steuben, was born on September 17, 1730 in Magdeburg Fortress. There were many individuals who were great historical figures during the Revolutionary War. Friedrich Von Steuben was one of those influential figures. He was famous for being a Prussian officer, writing the Revolutionary War Drill Manual, and his dedication to training the Continental Army. Just as his father did, Friedrich Von Steuben was a prussian officer when he was only 17 years old. Friedrich Von Steuben’s time as a prussian officer was very eventful. In the May of 1756 the Seven Years War had began in Europe, and Von Steuben had become a second lieutenant. Despite Baron Von Steuben being wounded and the Prussian Army being outnumbered 2 to 1, the Prussian army still won the Battle of Prague. He served as a principal staff officer and an adjutant to General Johann von Mayer during a special detached corps in 1758. He was promoted to first lieutenant and was wounded at the Battle of Kunersdorf in 1759. Baron Von Steuben served as a staff officer in the position of a deputy quartermaster when he was transferred to general headquarters. Soon after this he was taken as a prisoner when Major General Von Knoblock surrendered at Treptow. After a year in prison he was released and promoted to captain.
